Please note that the KD.com points program has now ended and membership registration has now closed. The Terms and Conditions listed below apply only to KD.com members registered on or prior to April 7th, 2011. Users may now redeem their points up until the usual date of expiration as per the original Terms and Conditions. The Platinum draw rules are no longer valid as all Platinum level members may redeem for Platinum prizes. Bronze level prizes are now available for all users to download. PROGRAM TERMS AND CONDITIONS
Welcome to the kraftdinner.com site, powered by Kraft Canada Inc. (hereinafter referred to as the "Site"). Kraft Canada Inc. and all its divisions, affiliates, and subsidiaries are referred to herein as "we", "us" or "our". This Site comprises various web pages and is owned and operated by Kraft Canada Inc. referred to herein as "Kraft". Parts of this Site may also be operated by our designated agencies or representatives. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS INTERNET SITE since use of this Site, including browsing, entering contests, accessing your KD points, and redeeming them for rewards from the online shop in the "Gotta Cash In" section of the site, are subject to the KD Program "Program" Terms and Conditions, together with our Privacy Promise, Contest Rules, and the Kraft Canada Website User Agreement (collectively "Terms and Conditions") and constitute the entire agreement between us and you regarding the subject matter of this Site, and supersede all prior or contemporaneous communications, whether electronic, oral or written between us and you with respect to such subject matter.
By using this Site in any manner whatsoever, you signify your agreement to these Terms and Conditions. If you do not agree to these Terms and Conditions of use, please do not use this Site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time without prior notice to you. Therefore, we urge you to read them carefully each time you use this Site. Your continued use of this Site following the posting of changes to these Terms and Conditions constitutes your acceptance of those changes.
OVERVIEW OF THE KD PROGRAM
The Program is sponsored by Kraft. It includes contests games, quizzes, chat groups, and a component through which you can earn KD points that can be redeemed for rewards offered on the Site. KD membership is a privilege that can be revoked by Kraft, in its sole discretion, without compensation to the KD member as a result of any act by such KD member that Kraft deems to be harmful to the KD Program, Site, or to Kraft.
Once you become a member of the KD Site ("Sign Up"), you are eligible to have an account in which you can start collecting points towards rewards. Points are earned by participating in a variety of activities on this Site. (See KD points below.) The more you participate in the activities the more points earned. Points have no monetary value, but can be accumulated and redeemed in accordance with the terms set out herein.
ELIGIBILITY
In order to be eligible to participate in the Program you must be a member of the Site and fulfill any other requirements as per the Sign Up page. Membership is open to individual legal residents of Canada 13 years of age and older, except (i) the employees, officers, directors, representatives and agents of Kraft, its respective advertising and promotion agencies, or any of the respective affiliates, related entities, successors or persons domiciled with any of the above. The Program is provided to individuals only. Corporations, associations, schools or other groups may not participate in the Program.
DURATION, MODIFICATION AND TERMINATION OF THE PROGRAM
The Program does not have a scheduled end date. We reserve the right to modify any of the Terms and Conditions set forth herein - including, but not limited to, the duration of the points earning period, eligible rewards, the amount of points required for each reward, the number of methods through which you may earn points, the number of points that may be redeemed in the Program, and any of the options made available to you with respect to your Account - at any time, without notice, even though these changes may affect your ability to accrue or use points. We are not obliged to continue the Program or to provide any notice of its termination or any changes we make to the Program.
HOW TO SIGN UP TO BECOME AN KD MEMBER
To sign up in the Program, you must have a valid email address. At the Sign Up Page, follow the prompts to register online including the submission of your name, age, email address, birthday and a unique username and password. By registering, we will set up a KD Account ("Account") associated with your unique username and password and a Profile will automatically be set up for you. Each KD member will have an Account that indicates their reward level and points to date. No purchase is required.
You may only register one Account . If it is discovered that you have attempted to register more than one Account all of your points and memberships that are in addition to the first membership and the Account you registered will be terminated automatically. We also reserve the right to terminate your original membership. Each member must have a verifiable unique individual name, and email address.
We reserve the right to terminate the membership of any KD member who engages in any fraudulent activity or uses the Program in a manner inconsistent with these Terms and Conditions or any federal, local, or provincial laws. Termination of your membership may result in the loss of all accumulated points and Program benefits. In addition to terminating your membership, we have the right to take appropriate administrative and/or legal action, including criminal prosecution, as we deem necessary in Kraft's sole discretion.
All questions or disputes regarding eligibility for the Program, earning or redemption of points or a member's compliance with these Terms and Conditions will be resolved by Kraft in its sole discretion.
KD POINTS
KD points are points that accrue to your personal Account as you engage in activities throughout the Site. See Table A below for details how points are earned through various activities on the Site. Your point total will be available for your private viewing on your profile page. KD points cannot be assigned, transferred, willed, traded, sold or otherwise disposed of, and can only be redeemed for items featured on the Site. Kraft reserves the right to discontinue awarding KD points at any time without notice and to void any points that have accumulated through robotic, automatic, mechanical, programmed, or similar methods.
We are not obliged to continue the KD points program or to provide any notice of its termination or any changes we make to the KD points program.

REDEEMING KD POINTS
You may redeem your KD points for rewards listed in the Gotta Cash In section of the Site. There are 4 reward levels. The first level is Bronze (10 000 points), followed by Silver (40,000 points), Gold (90,000 points) and Platinum (120,000 points). Members who reach Platinum level will have the option of entering into a Random Draw for Platinum level prizes. Kraft reserves the right to modify the reward levels and rewards at any time during the Program. You must comply with all terms, conditions, and restrictions applicable to each reward. Merchandise presented on this Site may only be redeemed with KD points, which have no cash value. We reserve the right to limit the quantities of certain products which you can redeem through this Site.
POINTS EXPIRY
Points earned at the Site expire on the last day of the calendar month, which is six months after the calendar month in which the points were earned, and will be automatically deleted from your Account. For example, if you earn points on January 2nd and January 28th, these points will not expire until 11:59 p.m. (ET) July 31st. If you earn points February 18th, these points will not expire until 11:59 p.m. (ET) August 31st. Kraft is in no way liable or responsible for expired points nor is Kraft legally responsible to communicate point expiry to users.
MERCHANDISE
Merchandise presented on this Site may from time to time be out of stock. We use our best commercial efforts to indicate which merchandise is out of stock as soon as possible. If merchandise is unavailable, Kraft reserves the right to substitute the item with an item of similar nature with equal or greater value. Merchandise may not be exactly as shown.
DELIVERY
Deliveries are free of charge and our fulfillment house aims to ship promptly after receiving your order. Please allow 4-6 weeks for shipping and handling. However, you acknowledge and agree that neither Kraft nor our fulfillment house will be held responsible for any delays in shipping or delivery. Merchandise redeemed from the Site can only be shipped in Canada to a street address (not a P.O. Box). Transactions with multiple redemptions of merchandise may be delivered separately. You will be required to complete all of the required fields in the online order form in order to redeem your KD points.
CANCELLATION OF ORDERS BY US
We reserve the right to refuse or cancel any orders containing any error, inaccuracy or omission, whether or not the order has been submitted, confirmed and/or KD points have been deducted from your KD points Account. If KD points from your KD points Account have been deducted for a redemption and your order is cancelled, we shall credit the KD points back to your KD points Account, although the six month expiry term will still apply.
RETURN POLICY
No cancellations, exchanges, refunds or returns for merchandise to Kraft once KD points have been redeemed. Merchandise redeemed on the Site may not be exchanged or refunded at any retail locations. Manufacturer's warranties apply according to the manufacturer's terms.
DISCLAIMER
PLEASE NOTE THAT ALL CONTENT ON THIS SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Model numbers are subject to change based on availability and without notice. All merchandise offered in exchange for KD points are subject to change and may be withdrawn without notice. The number of KD points required to redeem any given item is subject to change without notice.
ERRORS, INACCURACIES OR OMISSIONS
We make every effort to ensure that the content on this Site is complete and current. However, we do not guarantee that the information contained on this Site will not contain errors, inaccuracies or omissions. Such errors, inaccuracies or omissions may relate to points or to product description or availability. We reserve the right to correct any error, inaccuracy or omission or to change or update the content without prior notice to you. Further, we are not responsible for monitoring your KD points Account. You have the sole responsibility to ensure the accuracy of the number of KD points in your Account, and to verify that all other information in connection with your KD points Account is accurate. PRIVACY
The use of this Site is subject to the Kraft Canada Privacy Promise, which form a part of these Terms and Conditions.
SEVERABILITY
These Terms and Conditions shall be deemed severable. In the event that any provision of the Terms and Conditions is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.
